OAP Physically Dragged From Home After Missing Rent Payments

Juanita Fitzgerald, 93, was forcibly dragged out of her home and off to jail in Eustis, Florida this past Tuesday after missing rent payments.

Juanita Fitzgerald, of Eustis, is facing a trespassing charge after she refused to leave the National Church Residences' Franklin House after falling behind on her rent.

When Eustis police officers arrived at the community, Fitzgerald refused officers' commands to leave and told them, "Unless you carry me out of here, I'm not going anywhere", according to the Eustis Police Department report obtained by the Miami Herald.

Officers said while they were attempting to escort Fitzgerald out of the building, the 93-year-old intentionally slid out of her chair and onto the floor of the complex.

She spent about two days in the lake county jail before finally being released to a caregiver.

Fitzgerald did not have to pay bond but must appear for a December 27 court appearance, officials said.

Fitzgerald also had complained about having mold in her apartment, but said the facility had her apartment tested and no mold was found, Twinem said. Eventually, they manage to get her in the back of the police vehicle.

Police said staff of the Franklin House facility offered to help her move, but she refused. She was not handcuffed because of her age and the possibility of injury, WFTV reported. She allegedly refused them all. Moments later, a woman says "I want her to go in my auto - I would love for her to go in my vehicle". However, Fitzgerald reportedly refused to co-operate with the police and for that reason was arrested for trespassing on the property. She also noted that National Church Residences owns 340 properties. I don't need no help. My family is in Tennessee and I told them not to tell my son anything that's going on, ' she said. "We try to find places for people". Asked about why she would not pay the rent, the woman, who was handcuffed and appeared to have bruises up her arms, said of a housing facility employee: "She wouldn't take it, that woman blamed me for the mould".

"Ow, God, you're hurting me", Fitzgerald said.

She is now staying in a Tavares hotel room, which is being paid for with donations.
