He is scheduled to be arraigned on Friday on charges of first-degree murder and armed criminal action.

They say he agreed to show them the firearms he possessed.

The affidavit did not say why officers wanted to talk to him, but they told him they wanted to see guns he owned.

Police say he then changed his story and admitted he bought the gun for McCarthy who had asked him to do so. Police say they told Noble that he already knew the answer to that question. Police say Noble acted like he was visibly upset and faked crying.

Noble initially told two officers who visited his home on Thursday that he bought the rifle and sold it to McCarthy.

McCarthy was taken to a Kansas City area hospital for treatment and then was taken into custody at the Henry County jail. He took the two officers to the creek Thursday, where they recovered a rifle that "meets the description and appears to me to be the weapon used in the murder", according to the probable cause statement.

They say Noble told them he arrived home on Monday, Aug. 7th, at about 2:00 a.m., and found the rifle leaning against the inside doorway of his house.

"Noble said he panicked, told his wife he needed to take out the trash, took the gun and drove north of town", according to the affidavit.

The felony is punishable by up to four years in the Department of Corrections.

His bond has been set at $25,000 cash only.

When Michael exited his vehicle to initiate contact with the driver, he was shot, Lowe said, adding that the officer fired back but it's unknown at this time whether the driver was struck.

The prosecutor said he's considering more charges against Noble and whether to seek the death penalty against McCarthy.

Suspect Ian McCarthy was arrested Tuesday after he was spotted walking down Route U with a gunshot wound. Investigators believe McCarthy got out of his vehicle and shot at Officer Michael, killing him.

Officer Michael's Funeral is Saturday.
