The 28-year-old's lawyer, Ricardo Cardoso, told Spanish news agency EFE on Thursday that his client meant to "formally request a transfer" and also threatened Chelsea with legal action.

"At the moment, he does not want to play for a club other than Atletico Madrid".

"It was unfair behavious, a totally unacceptable lack of respect, all of which makes it impossible for Diego Costa to return to Chelsea".

Reports in the national press had previously suggested Conte had informed Costa that he was no longer wanted by the club via text message in June.

"The premise the lawyer has put forward is just wrong", the spokesman said.

"We'll just have to see what the window brings".

Diego Costa has rejected the chance to join AC Milan according to reports today, a move that could cost Chelsea nearly £4m.

The Spain global, 28, has been looking for a way out of Stamford Bridge since the end of last season after Antonio Conte sent him a text telling him he is no longer wanted, despite his 20 goals in 35 Premier League games.

Conte added: "For me the situation is simple. I repeat what I said in the past; the player, his agent and the club knew very well the future of the player in the summer", Conte told reporters yesterday.

"For sure, I don't understand why the lawyer has got involved". The situation is very clear.

AC Milan have held talks with Costa's agent Jorge Mendes, but the Brazil-born Spain international's lawyer Ricardo Cardoso says Atletico Madrid is the only club the forward wants to join, after he reacted angrily to a text message sent by Conte at the end of the Premier League season.

Costa has scored 52 goals in 89 Premier League appearances for Chelsea in the three years since joining from Atletico.
