It also asked the White House to provide records of interactions with Comey, including those "relating to the FBI's investigation of alleged ties between President Trump's associates and Russian Federation, or the Clinton email investigation, including all audio recordings, transcripts, notes, summaries, or memoranda", according to a statement. But he has set a hearing for May 24.

The requests to the Federal Bureau of Investigation went out as 33 congressional Democrats sent their own message to Chaffetz and House Judiciary Chairman Bob Goodlatte. Justice Department lawyers under presidents Richard Nixon and Bill Clinton also concluded a president can't be indicted because it would interfere with his constitutionally assigned duties.

Obstruction of justice is a felony offense for anyone who "obstructs, or impedes or endeavors to influence, obstruct or impede the due and proper administration of the law" when it comes to legal proceedings "being had before any department or agency of the United States, or the due and proper exercise of the power of inquiry under which any inquiry or investigation in being had by either House, or any committee of either House or any joint committee of the Congress". Even then, his testimonial would have little effect unless he could make it undeniably clear to a large group of Republicans that Trump has obstructed justice in some way.

U.S. Rep. Justin Amash, a Michigan Republican, said if the Comey memo is accurate, it could be grounds for impeachment. "But everybody in this country gets a fair trial, including the president or anyone else". But Vice President Mike Pence and Republican congressional leaders should stop looking the other way. The reality of the situation is that unless Trump voluntarily steps down himself, Paul Ryan and Mitch McConnell must agree that he must be removed from office, and the Republican majority must pursue impeachment charges.

"What you have is contemporaneous documentation of Comey's recollection of what the president said", said Bob Bauer, who served as White House counsel under President Barack Obama. Only an attorney working for Trump can give the president unvarnished, unconflicted advice without fear it will become public.
